USE OF THIS WEBSITE BY PERSONS UNDER 18

TLO TEXT CAMPAIGN PROGRAM

Program Description. Talbert Law Office, APC is committed to protecting your privacy. This Privacy Policy also governs how we treat the Personal Information that we collect and receive from you in connection with your use of the SMS Service (“Service”), which we make available to you through a third-party service provider. This Policy is incorporated into the Terms of Service.

We may send promotional and transactional mobile messages in various formats through our TLO Messaging Program (the “Program”). Promotional messages advertise and promote our products and services and may include appointment reminders, abandoned checkout reminders, promotions, specials, and other marketing efforts. Transactional messages relate to an existing or ongoing transaction and may include order notifications and updates, appointment reminders, and other transaction-related information.

Mobile messages may be send using automated technology, including an autodialer, automated system, or automatic telephone dialing system. Message frequency will vary, but will not exceed ten (10) messages per month. You agree that we, our affiliates, and any third-party service providers may send you messages regarding the foregoing topics. We do not charge for mobile messages sent through the Program, but you are responsible for any message and date rates imposed by your mobile provider, as standard date and message rates may apply for short message service and multimedia message alerts.

User Opt-In. By providing your mobile phone number to use, you are voluntarily opting in to the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to use is a valid mobile phone number of which you are the owner or authorized user.

If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at support@talbertlawoffice.com. Your participation in the Program does not require that you make any purchase from us and your participation in the Program is completely voluntary.

User Opt-Out and Support. You may opt-out of the Program at any time. If you wish to opt-out of the Program and stop receiving mobile messages from us, or you no longer agree to these mobile messaging terms, reply STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to the mobile number the message is sent from.

You may continue to receive text messages for a short period while we can process your request and you may received a one-time opt-out confirmation message. You understand and agree that the foregoing is the only reasonable method of opting out. Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these mobile messaging terms.

Disclaimer of Warranty and Liability. The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.

Modifications. We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these mobile messaging terms at any time. Any such modification will take effect when it is posted to our website. You agree to review these mobile messaging terms periodically to ensure that you are aware of any modifications. Your continued participation in the Program will constitute your acceptance of these modifications.

SHARING INFORMATION WITH THIRD PARTIES

 This website is managed and controlled by TLO located at 8690 Aero Drive, Suite 115, #4038, San Diego, CA 92123.

Disclosure to 3rd Parties. We do not sell, trade, or otherwise transfer your personal information or general information to third parties without informing you in advance. We provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties (collectively, "service partners"). Our service partners may use your personal information to operate our sites and to deliver their services. For example, your data may be transferred to website hosting partners and other parties who assist us in designing and operating the website, executing services (such as for prize fulfillment), or helping us analyze collected data. These parties will only use your data for the purpose of carrying out the work as agreed with us and will be required to keep the information confidential. - FloDesk to collect names and emails, and administer email marketing.
- Zoom to collect names and emails for appointment setting and event registration and access.
- Zapier to assist in the collection and transfer of personal information to third parties listed herein.
- ShowIt to administer website services.
- HelloSign to collect names and emails for automated contract signing and notifications.
- Lawpay to collect client payment information.
- Stripe to collect client payment information. 
- Dubsado to manage client and business relations and services.
 
Required Disclosures. TLO will release personal or general information without your consent for security purposes, when required by law, or to prevent imminent harm to any person or entity. We will disclose personal or general information on receipt of a court order or subpoena, or to cooperate with a law enforcement investigation, which may include responding to requests and court orders from jurisdictions outside the United States. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful, as determined in our sole discretion. Release of your personal data for security purposes, as described in this agreement, to any person or entity under any circumstances shall be based on a determination made solely by us, exercising our own discretion, permission for which is expressly granted by you to us in accordance with this Policy.

Links to 3rd Parties. From time to time we may insert links to third parties on this website including links from partners that may use TLO’s logo, name or other identifying features as part of a co-branding agreement. This Privacy Policy does not extend to third party websites. The sites those links can take you to have their own separate privacy policies and, although we seek to protect the integrity of our site, TLO is not liable for the content and activities of those sites. PAYMENT POLICY

If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater. You agree that you will request a refund prior to requesting a chargeback with your financial institution. In the event you attempt to acquire a chargeback, you will forfeit access to products and services from and by the TLO. We may present proof of your consent to these Terms of Use and your access to the products and services to the financial institution.

ASSUMPTION OF RISK

WAIVER

(1) DO I NEED A CONTRACT?
Of course you do! Contracts are the one of the most important ways to legally protect your business. Contracts make sure you get paid for your products or services, set clear expectations for your clients, protect you from liability, and secure your intellectual property interests.


(2) CAN I SHARE MY TEMPLATES FOR OTHER PEOPLE TO USE?

No. As you’ll see in our Terms of Use, contract templates are for your individual/business use only. You cannot share them with friends/family, etc. for their own individual/business needs.


(3) WHAT HAPPENS IF THERE IS A NEW LAW AND THE CONTRACTS GET UPDATED?

All of our contracts come with lifetime updates. If we update the contract, we will send you the updated version.


(4) I LIVE OUTSIDE OF THE UNITED STATES, CAN I USE YOUR TEMPLATES?

No. Our templates are not designed to be used for individuals/businesses based outside of the United States.


(5) WHAT IF I HAVE A LEGAL QUESTION?
If you have a legal question, please feel free to schedule a consultation with our office, and we’d be happy to help you or refer you to a licensed attorney who can assist you.


(6) HOW ARE THE TEMPLATES DELIVERED?
Your template will be delivered to you via e-mail in both PDF and Word format, along with a detailed user guide with instructions on how to fill in your template. The User Guide will include a glossary of legal terms used in the contract so that you can understand the contract terms and be able to explain them to clients.
